Governing Law & Dispute Resolution

1. Applicable Law
These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.
2. Jurisdiction for Legal Proceedings
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the courts of the Province of British Columbia, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country or province of residence or any other relevant jurisdiction.
3. Dispute Resolution Process
Initial Notification Requirement
Before filing any formal legal claim, you agree to first contact Enya Labs Inc. and attempt to resolve the dispute informally by sending a written notice of your claim by email to [email protected]. The notice must include your name, address, and a description of the nature and basis of the claim.
Mediation Procedure
If the dispute cannot be resolved within 60 days after the receipt of the notice, either party may request mediation. The mediation shall be conducted in Vancouver, British Columbia, unless otherwise agreed, and the costs of mediation shall be shared equally between the parties.
Arbitration Provisions
If mediation is unsuccessful, any unresolved dispute arising out of or relating to these Terms shall be finally settled under the Rules of Arbitration of the ADR Institute of Canada by one or more arbitrators appointed in accordance with the said Rules. The arbitration shall take place in Vancouver, British Columbia, and shall be conducted in English.
4. Class Action Waiver
You agree to resolve any disputes with Enya Labs Inc. on an individual basis only, and waive any right to bring or participate in any class, consolidated, or representative action or arbitration.
5. Small Claims Court Option
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction.
